Copyright Infringement Notice – Payment Required (Reference: Unauthorized Image Use)

Dear Tour Desk ehf.,

I have recently discovered that a photograph for which I hold the exclusive copyright has been published on your website without authorization.

The photograph appears on the following webpage:
https://book.tourdesk.com/Tour/Item/370898/1/exclusive-private-cruises-on-the-oslo-fjord

The image has been published on Tour Def without a valid license, without my consent, and without proper photo credit.

Under the Norwegian Copyright Act (Åndsverkloven), I hold the exclusive rights to reproduce and make my photographs available to the public. Unauthorized use of the work constitutes copyright infringement and gives rise to liability for remuneration and damages pursuant to Section 81 of the Norwegian Copyright Act.

Furthermore, under Section 81 of the Norwegian Copyright Act, the rights holder is entitled to claim:

• reasonable remuneration for the unauthorized use, and

• compensation for damages resulting from the infringement.

In addition, copyright protection and enforcement are supported by international agreements, including:

• the Berne Convention for the Protection of Literary and Artistic Works,

• the TRIPS Agreement, and

• relevant EU/EEA copyright enforcement frameworks.

These instruments ensure that copyright protection applies across international jurisdictions, including digital publications accessible online.

Payment

I therefore request payment of the attached invoice in the amount of:

NOK 3,875

This amount represents a reasonable licensing fee for the unauthorized use of the photograph, as well as compensation for the infringement.

Deadline

Please confirm in writing that the claim will be settled no later than Friday, 13 March 2026.

If I do not receive confirmation and payment within this deadline, the matter will be transferred to my international legal partner for recovery and enforcement of my rights, which may result in additional costs and legal proceedings.

Can I just remove the image and consider the case closed?

No. An agreement or licence is required to be in place prior to the publication of an image online. Publishing the image without these agreements or licences is an automatic infringement of copyright law and, as the infringement has already occurred, the copyright owner is entitled to compensation for the unauthorised use of their material.

Liability notice

Even if the photograph was obtained from a third party, you remain legally responsible for all content published on your website. Our claim for compensation is therefore directed solely to you as the publisher.

Please confirm receipt of this notice.

For the avoidance of doubt, the unauthorized use of the photograph has been documented and preserved as evidence.
